This program will be a four

part presentation which will include development of a tool box of negotiation tools and strategies

that are easily applicable to newer female attorneys in a variety of settings, including interviewing, salary negotiations, man-

aging office relationships and receiving credit for work done, mediation, and interactions with Judges and other court offi-

cials. It will also include the development of an outline of the legal and ethical considerations for the disclosure of confiden-

tial employment records, both on behalf of a potential new hire and on behalf of a former employer, so that attorneys know

what to expect and can strategize accordingly when negotiating with a potential employer.

In June of 2015, the U.S. Supreme Court ruled that same

-

sex couples have a constitutionally protected right to marry and,

as a corollary, LGBT individuals are protected by the due process clause and the equal protection clause of the 14th

Amendment. That same month, Caitlyn Jenner appeared on the cover of Vanity Fair magazine and announced to the world

that she was transitioning her gender. Those two events in the span of a week changed the conversation across the country

and, at the same time, placed employers in the crosshairs of two groups asserting their newly

-

protected rights: LGBT work-

ers and workers who oppose LGBT rights based on their religious beliefs. This session will review the current legal protec-

tions surrounding sexual

-

orientation and transgender

-

based discrimination, the religious exemptions to such protections

and what employers need to know to accommodate these protected and competing rights.

Based upon a composite of challenging cases, the presenters will explore the legal, ethical, and financial considerations

when advocating for Alleged Incapacitated Persons with and without capacity in MHL Article 81 Guardianship proceedings.

The program includes audience participation in a client interview and a mock hearing, which will focus on the role, duties,

and ethics of the attorney pursuant to MHL section 81.10, with special emphasis on trial preparation and effective court-

room skills. The facilitators will also discuss CPLR Article 45 privileges, provisional remedies pursuant to section 81.23,

criminal background checks pursuant to section 81.19, and recent case law about the applicability of orders of protection

and sealing the courtroom and records.

The program is based on a recent study on gender and ethics, in which researchers found women receive harsher

punishments than men for ethical violations at work, including women in the legal profession. The program will review

the results of the study in which women were punished more severely for the same ethical violations as men. The

program will then provide examples of the most commonly violated attorney ethics rules and tips on the simple ways

attorneys can avoid a violation of the rules.
