LAW-2078 Cuba Seminar: Comparative Criminal Law and

Procedure: Cuba and the U.S.

Cuba Seminar: Comparative Criminal Law and Procedure: Cuba and the U.S. This seminar will

compare the process of a criminal case in the United States with the process of a criminal case in

Cuba. The course will examine the respective Constitutional provisions, laws, rules of procedure,

authority and limits from arrest, arraignment, discovery and pre-trial matters, motion practice,

the use of juries, trial and sentencing, of each nation. This two credit course has two required

components: a weekly seminar during the spring 2017 semester and an in residence component

at the University of Havana from approximately March 13-17 (Spring break). The University of

Havana component will include students and faculty from the University of Havana Law School.

This course is only available to those students who, in addition to the weekly seminar, can

participate in the weeklong Havana component for which there will be additional expenses for

travel, housing and other costs during the time in Havana, all of which are to be paid by each

student. In order to register for this course a student’s application must first be approved by

Professor Borenstein in accordance with application procedures and deadlines to be published

separately.

Faculty comments

: Grades will be based on a final paper of approximately 20 pages in length

and class participation.
