GARDA A T T ENDANCE AT
COURT HEAR I NGS
Mr. J O'Keeffe T.D. asked the
Minister for Justice the reason re-
imbursement was not sought by
the State for the cost of Gardai
summoned to attend court hear-
ings in civil actions for damages;
and if he would give an assessment
or estimate of such cost annually.
The Minister for Justice replied in
the Dáil, 401

990, July 10, 1990, that Gardai
attending court in their official
capacity as witnesses in a civil
case were deemed to be on duty
and, accordingly, had an
entitlement to their pay in respect
of such attendance in accordance
with the terms and conditions of
their employment. The Minister
stated that persons attending court
as witnesses were entitled only to
compensation in respect of actual
loss of earnings or expenses incurred
in attending. Additional costs arising
where gardai attend in such cases,
ij& travel and subsistence expenses,
were borne by the litigants. The
Minister stated that records were not
kept in such a way as to allow the
annual cost of Garda attendance in
court as witnesses in civil actions
to be estimated without diverting
gardai and staff of his Department
from other more pressing duties. •
