GAPS IN THE LEGAL REGIME OF INTERSTATE
COOPERATION IN PROSECUTING CRIMES
UNDER INTERNATIONAL LAW

Abstract:
The aim of this article is to briefly describe the gaps in the legal regime
of interstate cooperation in prosecuting crimes under international law (crimes
against humanity, genocide, war crimes)
,
as well as current governmental and non-
governmental initiatives and proposals how to close these gaps (focusing mostly,
but not exclusively, on gaps in prosecuting crimes against humanity) and comment
on some sailient or novel features of these inititives and proposals. These initiatives
are namely the joint initiative of Argentina, Belgium, the Netherlands, Slovenia
and Senegal to elaborate a convention on interstate cooperation in the prosecution
of serious crimes under international law; the work of the International Law
Commission on the topic “Crimes against humanity” and other relevant topics; and
the non-governmental Proposed International Convention for the Prevention and
Punishment of Crimes against Humanity. In this regard, some connected issues are
briefly touched upon, such as the relevance of the obligation to extradite or prosecute
in closing the gaps in this area; the relationship of a possible new international legal
instrument to existing treaty regimes for the prosecution of serious crimes, namely
the Rome Statute; the relationship of immunities under customary international law
to any such new instrument; or a possible institutional mechanism established under
any future instrument.
Resumé:
Účelem tohoto článku je
stručně popsat existující mezery v mezinárodně-
právní úpravě mezistátní spolupráce při stíhání zločinů podle mezinárodního práva
(zločinů proti lidskosti, genocidy a válečných zločinů), jakož i současné vládní a ne-
vládní inicativy a návrhy (zaměřující se zejména, nikoliv však výlučně, na stíhání
zločinů proti lidskosti), jak právně „zacelit“ tyto mezery, a poskytnout stručný ko-
mentář k některým významným či novým prvkům těchto návrhů a iniciativ. Člá-
nek se zaměřuje na společnou iniciativu Argentiny, Belgie, Nizozemska, Senegalu
a Slovinska na sjednání úmluvy o mezinárodní spolupráci při stíhání závažných
zločinů podle mezinárodního práva; jednání Komise pro mezinárodní právo o té-
matu „zločiny proti lidskosti“ a dalších souvisejících tématech; a nevládní Návrh
mezinárodní úmluvy o prevenci a trestání zločinů proti lidskosti. V tomto ohledu
jsou stručně zmíněny mj.: význam závazku „vydat nebo stíhat“ při „zacelování“
existujících právních mezer v této oblasti; vztah případné nově vzniklé mezinárodní
smlouvy k existujícím mezinárodním smlouvám, jejichž účelem je stíhání závaž-
ných zločinů, zejména k Římskému statutu Mezinárodního trestního soudu; vztah
imunit podle mezinárodního práva obyčejového k takovéto případné nově vzniklé
