TTIP AND ISDS: NOT IRRECONCILABLE ACRONYMS

Abstract:
This contribution focuses on a highly controversial issue of recent
times – the inclusion of investment protection provisions, including investor-state
arbitration (ISDS), in the Transatlantic Trade and Investment Partnership (TTIP),
currently being negotiated between the European Union and the United States. The
whole agreement and, in particular, an investment chapter have become an object
of the heated public debate on the side of EU, and the negotiator, the European
Commission, has to deal with increasing pressure from the public, EU institutions
and the Member States. Under these circumstances, the European Commission
is preparing substantial reform proposals in the area of investment protection,
e.g.
introduction of an appellate mechanism, to placate critics and save the investment
chapter, including ISDS in the TTIP. This paper briefly examines the current state
of the public debate about investment protection in the EU and puts theTTIP in a
broader context of the reform of the international investment treaty regime.
Resumé:
Tento příspěvek se zaměřuje na vysoce kontroverzní téma poslední doby
– zahrnutí ustanovení investiční ochrany, včetně mechanismu řešení sporů investor
– stát (ISDS), v Transatlantickém obchodním a investičním partnerství (TTIP),
které je v současnosti předmětem vyjednávání mezi Evropskou unií a Spojenými
státy. Celá dohoda a zvláště její investiční část se staly předmětem vzrušené veřejné
diskuze v Evropské unii a její vyjednavač, Evropská komise, se nyní musí vypořá-
dat s rostoucím tlakem ze strany veřejnosti, evropských institucí a členských států.
Za těchto okolností Evropská komise připravuje v oblasti ochrany investic zásadní
reformní návrhy jako např. vytvoření odvolacího mechanismu s cílem uspokojit
kritiky a zachránit investiční kapitolu, včetně ISDS, v TTIP. Příspěvek zkoumá
současný stav veřejné debaty o investiční ochraně v EU a zasazuje TTIP do širšího
kontextu reformy systému mezinárodních investičních dohod.

Mgr. Bc. Ondřej Svoboda serves as an officer at the Unit of
International Law at the Ministry of Industry and Trade of the Czech Republic. He
graduated from the Faculty of law, Charles University in Prague in 2014. He also
holds the equivalent of a B.A. degree in international area studies from the Faculty
of Social Sciences, Charles University in Prague. From 2009 to 2010 he studied
international relations and politics at the University of Kent under the Erasmus
