For districts that have participated in the ELPP and are completing their
construction or renovation through the CFAP, the commission shall use
the district’s percentile ranking determined at the time the district
entered into the ELPP.
A district that has completed its local portion of an ELP project may
be eligible for state assistance before it would otherwise be eligible
based on its percentile rank if the Ohio Construction Facilities
Commission (OCFC) determines the following:
1)the district has expended its local share on a “discrete part” of
its district-wide project in accordance with its ELP
agreement;
2)the district is ready to complete the district-wide project or a
segment as identified in the ELP agreement;
3)and the local funds for maintenance (ORC 3318.36) are in
place.
The OCFC cannot fund such ELP projects unless sufficient state funds
have been appropriated for that particular fiscal year to fund the state’s
share for all of the following:
1)previously lapsed districts;
2)districts completing projects under rules existing prior to May 20,
1997;
3)exceptional needs districts; and
4)accelerated urban school building assistance districts.
The Exceptional Needs Program (ENO) provides support for districts
with a need for new facilities to protect the health and safety of students.
ENP eligibility does not extend to a district participating in an expedited
local partnership (ELP) project or approved for an ELP project prior to
September 14, 2000.
OCFC also provides assistance to joint vocational school districts on a
graduated, cost-sharing basis similar to other school districts under the
CFAP. Among the options for financing the local share of the
renovation/construction project are: issuance of securities; local
donated contributions; a permanent improvement levy; and bonds. A
JVSD board can combine in a single resolution propositions to commit
the use of existing or new tax levies to finance the annual debt service
on bonds issued for both its state-assisted classroom facilities project
and locally funded initiatives related to that project.

ACTION PROGRAM
(CAP)
The Ohio Facilities Construction Commission may grant funds to
districts to correct deficiencies or omitted work connected with a project.
District must notify Commission of defects or omissions within five years
of facility occupancy, and the Commission is required to engage the
responsible contractors.
The CAP requires a local share of the cost of the corrective work, but a
district may request additional state assistance if the district cannot
provide its share.
The Commission is required to seek recovery from any responsible
party and to apply any recovered funds first to the district’s share of the
cost of the corrective work.
