Commission scale fee in administration and pro

bate matters-

It was decided that members should be reminded

that the commission scale fee published by the

Society is merely a sign post or guide and must

not be quoted as an official scale or adopted indis

criminately without regard to relevant consider

ations including the value of the estate and the

nature and amount of the professional services

rendered. Correspondence reaching the Society

suggests that some members have quoted the

scale as authoritative and applied it indiscrimi

nately. A statement will be published in a future

issue of the Gazette.

Irish Legal Terms Advisory Committee

Mr. Anthony O'hUadhaigh was reappointed as

the Society's representative on this committee for

a further period of five years.

Privilege, disclosure to Revenue Commissioners

A testator died domiciled in the Republic of

Ireland leaving substantial assets. Grants of pro

bate were taken out in Ireland, England and

Scotland. The estate consisted principally of invest

ments all of which were transferred to the executor

as residuary legatee. The Revenue Commissioners

are pressing for delivery of a residuary account

and payment of 5% legacy duty on the net residue.

The executor refuses to authorise member, as his

solicitor, to complete and lodge the account, and

member asks for guidance from the Council. On

a report from a committee the Council stated that

member should inform the Revenue Commis

sioners that he has -no instructions to submit the

accounts and is not entitled to do so without

instruction.

Probate Office, copying facilities

It was decided that a letter be written to the

Department of Justice suggesting that the Probate

Office should have a separate Rank Xerox copying

machine with a view to having certified copies of

grants issued at the same time as the original

grant.

Commissioners for Oaths, interest

On a report from a committee the Council stated

that in their opinion a solicitor who acted in cer

tain matters for a lending institution is not thereby

disqualified from authenticating as Commissioners

for Oaths affidavits prepared by other solicitors

acting for the same client in different matters.

Mortgagee's solicitor- Approval fee on release of

mortgagee

A mortgage contains a stipulation that the mort

gagor would be entitled to redeem the mortgage

at his own expense. The Council on a report from

a committee stated that on the facts submitted the

mortgagee's solicitor would be entitled to an

approval fee and

the Commissioner's

fee on

memorial.
