P.S. Since writing above we note from
this weeks
I.T.P.A. Gazette
that A. H. Masser Ltd., have
obtaining judgment. We feel that our clients were first
debtor. We are asking our Town Agent to contact
their solicitors to know if they experienced difficulty in
obaining judgment. We feel that our clients were first
in the field and that we are therefore in a most
embarrassing position with them.

EDITORIAL NOTE
Representations
on
the
lines
suggested
by
our
correspondent were made to the Committee on Court
Practice and Procedure. It was suggested on behalf of
the Sociey that the entire practice of the Superior Courts
should be assimilated to the practice in the Circuit Court
other than
the requirement of service by Civil Bill
Officers.
RATIONALIZATION OF THE LAW

Dear Sir,
1. Will some profound Committee make some sensible
recommendation to get away from the nonsense of having
County Registrars in some places and Sheriffs in other
places. Why can we not call them all either County
Registrars or Sheriffs or give them some one title, so
that we would not have business held up over this sort
of footling distinction.
2. Can we obtain from the High Court, the Circuit
Court and the District Court the same period of time
for entering an appearance, and try and get the situation
with
regard
to Statements of Claim and Defences
rationalized between the three jurisdictions ?
3. To serve a High Court Summons one has to be
over sixteen years of age, but to serve a Circuit Court
Civil Bill one has to serve it through a Civil Bill Officer
and in the absence of a Civil Bill Officer then the docu
ment may be posted but only by somebody who is over
twenty one years of age.
4. There is so much of this practice that is crying out
for revision and unfortunately so many of us have not
got the time to separate ourselves from our own work

Registration of Title Act, 1964
Applications have been received from the registered
owners mentioned in the Schedule annexed hereto, for
the issue of Certificates of Title in substitution for the
original Certificates
issued
in
respect of
the
lands
specified in the said Schedule, which original Certificates,
it is alleged, have been lost or inadvertently destroyed.
A new Certificate will be issued in each case, except
a case in respect of which notification is received in this
Registry within 28 days from the publication of this
notice, that the Certificate of Title is still in existence,
and
in
the custody of some person other than
the
registered owner. Any such notification should state the
grounds on which such Certificate is being held.
