guilty. On application that the State should pay
costs was adjourned until April, 1967. The judg
ment of the Court which was delivered in Octo
ber, 1967 referred to the transfer of jurisdiction
under the Judicature Act, 1877 as well as the in
herent jurisdiction under article 34 of the Consti
tution and the stated jurisdiction conferred under
the Courts (Supplemental provisions) Act, 1961.
The matter was fully considered and Kenny J.
held that the Central Criminal Court has power
in its discretion to award costs to an accused who
has been acquitted—Miss Brady's costs, limited to
nine days were awarded and no costs were awar
ded to the other five accused save two days argu
ment to Miss Dillon. (2nd October 1967).
