WHAT IS THE LEGAL REGIME OF THE ARCTIC?

Abstract:
Unlike the case of Antarctica there is no special legal regime for the
Arctic. The question may therefore arise as to what the legal regime for the Arctic
is. The Arctic is a specific polar region located at the northernmost part of the
Earth. It is mainly sea, but, as it is mainly frozen sea, this raises the issue of a
specific legal regime for this region. It can be therefore said that the complex
international legal regime which regulates the Arctic Ocean is contained in the
United Nations Convention on the Law of the Sea of 1982. On the basis of this
Convention states raise claims for the continental shelf beyond the 200 nautical
miles, which would allow them exclusive exploration of the resources in their area
of the continental shelf. It can be seen that the legal regulation of the continental
shelf contained in the UN Convention on the Law of the Sea raises questions
which are not satisfactorily regulated. The Arctic region is not regulated only by
the rules of the international law of the sea. Apart from these rules important
rules from the area of international environmental law also apply. The necessity
of resolving various questions pertaining to the Arctic led to the creation of the
Arctic Council in 1996. One of the main questions for the future is the interest
of the Arctic states, but also other states interested in the Arctic, in protecting
its environment, or whether the exploration of the resources, mainly mineral
resources, will prevail.
Resumé:
Na rozdíl od Antarktidy neexistuje speciální právní režim týkající se Arkti-
dy. Vyvstává otázka právního režimu Arktidy. Arktida je specifická oblast okolo sever-
ního pólu, na jedné straně se jedná v podstatě o moře, na druhé straně je to do značné
míry zamrzlé moře což právě vyvolává možné otázky o specifikách režimu této oblasti.
Přičemž se dá konstatovat, že komplexní mezinárodní právní režim, který upravuje
otázky Arktického oceánu je obsažen v Úmluvě OSN o mořském právu z roku 1982.
Na základě této úpravy vznáší nároky na kontinentální šelf za hranicemi 200 námoř-
ních mil, které by jim umožnily výhradní čerpání zdrojů v oblasti jejich kontinentál-
ního šelfu. Ukazuje se, že právní úprava kontinentálního šelfu obsažená v Úmluvě
OSN o mořském právu vyvolává řadu otázek, které v ní nejsou jednoznačně upraveny.
Na Arktickou oblast se nevztahují jen normy mezinárodního mořského práva. Vedle
těchto pravidel jsou rovněž důležitá pravidla v oblasti mezinárodní ochrany životního
prostředí. Nutnost řešit různé otázky spojené s Arktidou vedla k založení Arktické
Rady v roce 1996. Jednou z hlavních otázek do budoucnosti je, do jaké míry arktic-
ké, ale i další státy mající zájem o oblast Arktidy budou mít chtít chránit její životní
prostředí nebo zda převáží zájem na využívání jejího zejména nerostného bohatství.
