Initially, I believe that MDPs
should b? opposed. In a small
country such as Ireland, w i th a
small commercial and business
base introduction of anything
other than a strictly controlled
f o rm of MDP would be in-
judicious.
It is not app r op r i a te to
compare large and economically
s t r onger soc i e t i es such as
Germany, the Netherlands and
the UK, to Ireland.
If MDPs are however intro-
duced I believe the Law Society
should:
1.
Ensure that solicitors are
dominant i.e. forbid MDPs
w i th any non-independent
profession (stock brokers/
merchant banks/ estate
agents).
2 .
Ensure that professions
w i t h w h om MDPs are
a l l owed have similar
standards/codes of con-
duct to solicitors (i.e. the
Dutch model).
3 .
Permit only MDPs w i th
other advisers/thus ex-
cluding accountants who
audit company accounts,
since they may be deemed
officers of companies.
Ensure t h a t t he Law
Society has the power
to control any involve-
ment by a solicitor in an
MDP.
Ensure that (at least) the
Bar Coun c il and t he
Law So c i e ty adopt a
common approach to this
matter.
