Sec. 18-113. Abandoned vehicle unlawful; removal authorized.

(a)

It shall be unlawful for the registered owner or person entitled to possession of a

vehicle to cause or allow such vehicle to be abandoned.

(b)

Upon investigation, the code enforcement officer and/or Police Department may

determine that a vehicle is an abandoned vehicle and order the vehicle removed.

(c)

In addition to or in lieu of the misdemeanor penalty, any person, violator, owner,

agent, property manager, tenant, or other parties of interest, violating any

provision of this ordinance, or violating or failing to comply with any order made

hereunder after having received written notice from the Code Enforcement

Officer, the Town Manager, and/or any of his/her assignee(s), shall be liable to

the town for a civil penalty in the amount of fifty dollars ($50.00) per violations

per day. Each day’s violation shall constitute a separate act subject to civil

penalty. Any penalty shall be payable in full within thirty (30) days after notice

thereof to the violator. Such penalty is payable to the town as established in

Section 18-85.

Sec. 18-114. Nuisance vehicle unlawful; removal authorized.

(a)

It shall be unlawful for the registered owner or person entitled to possession of a

motor vehicle, or for the owner, lessee or occupant of the real property upon

which the vehicle is located to leave or allow the vehicle to remain on the

property after it has been declared a nuisance vehicle.

(b)

Upon investigation, the code enforcement officer and/or police department may

determine and declare that a vehicle is a health or safety hazard and a nuisance

vehicle, and order the vehicle removed.

(c)

In addition to or in lieu of the misdemeanor penalty, any person, violator, owners,

agent, property manager, tenant, or other parties of interest, violating any

provision of this ordinance, or violating or failing to comply with any order made

hereunder after having received written notice from the Code Enforcement
