and discarded in a refuse container which is regularly emptied by the municipality or some other
refuse collector; or disposal into a system designed to convey domestic sewage for proper
treatment and disposal.
Sec. 18-203. Requirement for Disposal.
It is the duty of each person in control of a pet to promptly remove and dispose of, in a
sanitary manner, pet solid waste left by such pet. All pet solid waste shall be property disposed
of per the requirements below:
(1)
All pet owners and keepers are required to immediately and property dispose of
their pet’s solid waste deposited on any property, public or private, not owned or
possessed by that person.
(2)
On any property owned or possessed by that person, all pet owners and keepers
are required to dispose of their pet’s solid waste at a frequency of at least weekly
or more frequently if necessary to prevent a public health nuisance.
(3)
The owner or keeper of any pet shall not take the pet off the owner/keeper’s
property without the means to properly and immediately remove and dispose of
the pet’s solid waste from any public property. “Means to properly and
immediately remove and dispose of the pet’s solid waste” shall consist of having
on one’s person a device such as a plastic bag or other suitable “scooper”, that can
be used to fully clean up and contain the pet’s solid waste until it can be deposited
in a closed trash receptacle or other appropriate refuse container. Such a device
must be produced and shown upon request to anyone authorized to enforce this
ordinance.
Sec. 18-204. Exemptions.
Any owner who requires the use of a disability assistance pet shall be exempt from the
provisions of this section while such pet is being used for that purpose. Any pet used by a law
enforcement agency in the investigation of crimes or as otherwise necessary in the enforcement
of the law shall be exempt from the provisions of this section while such pet is being used for
that purpose.
