MUTUAL RESPECT AND RESIDUAL TENSIONS BETWEEN
THE SYSTEMS OF PROTECTION OF FUNDAMENTAL
RIGHTS IN EUROPE

Abstract:
The EU system of protection of fundamental rights is based on Article 6
TEU and on the Charter of Fundamental Rights, both of which promote a mutual
respect between this system, on the one hand, and the ECHR system and national
systems of fundamental rights on the other. However, certain tensions remain. The
Court of Justice seems to have created such a tension when it defined the scope of
application of the Charter widely. At the same time, it counterbalanced this principle
by a formal recognition of a subsidiary approach in the field of fundamental rights.
While the national courts have, in principle, respected the primacy of the EU system
of fundamental rights, some constitutional courts have not abandoned an “emergency
brake” reserve, according to which they claim the right to review, in extreme cases,
the respect for national standards of fundamental rights by EU law. The relationship
between the EU and ECHR systems has been recently marked, in particular, by
the finalisation of the agreement on the accession of the Union to the ECHR. This
accession will probably change the relationship between these systems as the
Bosphorus
doctrine of the European Court of Human Rights is based on a premise that the EU
is not a contracting party of the ECHR and is not formally bound by this convention.

Unijní systém ochrany základních práv je založen na článku 6 SEU
a na Listině základních práv EU, které podporují vzájemný respekt mezi tímto systé-
mem, na straně jedné, a systémem EÚLP a vnitrostátními systémy základních práv
na straně druhé. Určité napětí mezi těmito systémy však stále existuje. Soudní dvůr
takové napětí v poslední době patrně vytvořil tím, že široce definoval působnost
Listiny. Současně tento princip vyvážil formálním uznáním subsidiárního přístupu
v oblasti základních práv. Pokud jde o vnitrostátní soudy, ty v zásadě respektovaly
přednost unijního systému základních práv. Některé ústavní soudy však stále uplat-
ňují výhradu „záchranné brzdy“, když si vyhrazují právo přezkoumat v extrémních
případech, zda systém EU respektuje vnitrostátní standard ochrany lidských práv.
Vztah mezi systémem EU a systému EÚLP byl v poslední době ovlivněn zejména
tím, že byla dokončena dohoda o přistoupení Unie k EÚLP. Toto přistoupení patr-
ně změní vztah mezi těmito systémy, protože doktrína

pro lidská práva je založena na předpokladu, že Unie není smluvní stranou EÚLP
a není formálně vázána touto úmluvou.
