Article 5 Lot and Building Standards 5-12 Cluster and Open Space Development

(B) Open Space Development The minimum required land area for an open space development is 25 acres. 5-12-4 Minimum Open Space (A) Cluster Development (1) At least 10% of the land area within a cluster development must be set aside and permanently preserved as open space if the development is located within an Urban Services Area or Urban Services Area/Water Supply Watershed. (2) Cluster developments located in a Non-Urban Area, and Non-Urban Area/Water Supply Watershed must set aside and permanently preserve at least 25% of the subdivision’s total land area as open space. (B) Open Space Development (1) At least 30% of the land area within an open space development must be set aside and permanently preserved as open space if the development is located within an Urban Services Area or Urban Services Area/Water Supply Watershed. (2) Open space developments located within Non-Urban Services Areas or Non-Urban Services Areas/Water Supply Watershed must set aside and permanently preserve at least 40% of the subdivision’s total land area as open space. (See Part 3 of this article [p. 5-11] for rules governing measurement of and exceptions to these standards):
