Discovering Brazil
Dismissal:
30 days advanced notice of dismissal must be given. If you want your
worker to leave immediately, which is often advisable, you must pay an accrued
salary in addition to dismissal payments
-
Proportional monthly salary, proportional 13th salary and proportional vacation
with its additional vacation bonus (for employees of more than one year, if not
already issued)
-
Be sure to enter the termination into the former workers CTPS booklet, with the
date of dismissal and salaries paid before making the final payment
-
If the household help worker quits or abandons the position, they are not entitled
to dismissal payments
Employer Rights
An employer has the right to 30 days advanced notice if the household help worker
wants to leave their position, but this seldom happens. It is advisable to have your
former worker sign a statement that they are leaving of their choice and therefore
forfeits the right to any dismissal payments
An employer has the right to fire a household help worker for any reason, as long as
any dismissal payments are made. Have your former worker sign a receipt stating
this is the final payment and they will have no future claims on the employer. If you
were satisfied with the quality of your former worker, it is customary to help them to
find a new job
Requiring a uniform is a personal decision between you and your household help
worker. You may provide the uniforms, which can be purchased at stores like
Carrefour, Eldorado, or any local
feira
; however, the worker may prefer to wear more
casual clothes to perform some tasks. This is usually decided at the time of hiring
