LEGAL DECISION AFFECTING

SOLICITORS.

NORTHERN LAND COMMISSION.

13th Jan., 1928. Land Purchase Act.

Priority of Owner's Costs.

The Judicial Commissioner in the Court of

the Land Purchase Commission for Northern

Ireland, gave a

considered

judgment

in

respect of an application brought before him

in the matter of the estate of Edith Stringer

and others, owners, County Tyrone.

The

application was that the owners' costs of

making title and carrying out the directions

of the Land Purchase Commission, under the

Northern Ireland Land Act, 1925, should

have priority in the distribution of the pur

chase money, over the superior interests, such

as head rent. The purchase money only

amounted to

£95,

and this, it was stated,

was insufficient to pay the costs, head rent,

and other charges.

The Commissioner reviewed the various

legal aspects of the case, and pointed out

that extra costs were involved in securing

from the United States a certified copy of a

document necessary

to

the proceedings.

Under the statutes certain things had to be

done, and under the Act the owners and their

Solicitors had carried out their statutory

duties. He therefore held that the costs were

a first charge on the purchase money.
