Obituary.

MR. RICHARD J. O'DONNELL, Solicitor,

died upon the 16th January, 1923, at his

residence, The Cottage, Carrick-on-Suir.

Mr. O'Doiinell served his apprenticeship

with the late Mr. Patrick J. Kenny, Carrick-

on-Suir ;

was admitted in Trinity Sittings,

1895, and practised at Carrick-on-Suir.

MR. NORMAN C. CARUTH, Solicitor, died

upon the 24th January, 1923, at his residence,

Drumard, Ballymena.

Mr. Caruth served his apprenticeship with

his father, the late Mr. Alexander Caruth,

Ballymena ;

was admitted in Michaelmas

Sittings, 1893, and practised (formerly in

partnership with his father) under the style

of Messrs. Alexander Caruth and Son, at

Ballymena.

MR. RICHARD W. DOHERTY, Solicitor, died

upon the 12th June, 1922, at Penzance,

England.

Mr. Doherty was admitted in Michaelmas

Sittings, 1878, and practised at Bandon.

Land Purchase.

A deputation from the Council have had

an interview with the Judicial Commissioner

in reference to a Land Commission Notice

to Solicitors, which has recently appeared

in the

Legal Diary,

dealing with future

procedure in cases where allocation takes

place after the Closing Day, and at that

interview it was arranged that the attention

of members should be directed to this matter

in the Society's GAZETTE.

The Council desire, accordingly, to draw

the attention of members to the urgent

necessity of expedition on the part of Vendors'

Solicitors, so that allocation should take

place before the Closing Day.

The Judicial Commissioner informed the

deputation that he is always ready to hear

applications in reference to requisitions on

title issued by an Examiner which

the

Solicitor may find himself unable to discharge.

Where the Closing Day has passed before

allocation, the Examiner is, by direction of

the Judicial Commissioner, not to vouch any

sum for Vendor's costs, and in all such cases

an

affidavit by

the Vendor's Solicitor

explanatory of the delay in the case will be

necessary on the ruling of the Schedule of

Incumbrances by the Judicial Commissioner

when the item of the Vendor's costs is being

dealt with.

Assessment of Damages to Property.

The Council received, on the 17th January,

a joint deputation consisting of Mr. G. P,

Sheridan, President, and George F. Beckett.

Hon. Secretary, of the Royal Institute of

Architects ;

and Mr. Pierce F. Purcell,

President, and Mr. J. Chaloner Smith, Hon.

Secretary,

of

the

Institution

of Civil

Engineers, who urged the Council to use its

influence with the members of the Solicitors'

profession to secure the employment of pro

fessionally qualified persons in the prepara

tion of claims, and the assessment of damages

to property, in malicious injuries cases. The

Council, in reply, assured the deputation of

their sympathy with the views put forward,

and intimated that the matter would be

brought before the members of the Society

in this GAZETTE.

The Council desire to urge on the members

of the Society, so far as they may find it

practicable,

to

employ

professionally

qualified persons for the purposes indicated.

The deputation stated that there is no fixed

scale of remuneration laid down for this work

by either of the bodies represented by the

deputation, the matter of remuneration being

one for arrangement with the professional

person employed.

The Secretary of this

Society has received lists of the names and

addresses of the members of both bodies, and

he will furnish to any member of this Society

who may apply the names and addresses of

the professional men resident in any particular

district in Ireland.
