GAZETTE

JULY 1996

situations) and the rule is without

prejudice to any entitlement of the

spouse to seek other redress from the

other spouse. It further provides

whether before or after the passing of

the Act a spouse has given a general

consent in writing to a future

conveyance of a family home then

such consent shall be deemed to be a

prior written consent in writing of the

spouse to that conveyance.

Furthermore where a Court orders that

the ownership of the family home

shall be vested in one spouse it shall

(unless it sees reason to the contrary)

also order that a prior written consent

of the non owing spouse shall not

apply.

A full and detailed analysis of

Section 54 will be the subject

matter of consideration by the Law

Society Conveyancing Committee

and practitioners are advised to

consider this section carefully as it

is far from simple.

The commencement of the 1995 Act is

welcomed by Family Law

practitioners. The ability of the Court

to make financial compensation orders

will undoubtedly benefit spouses who

will be provided for in the event of the

death of the other. Pension

Adjustment Orders will give further

relief but Pension Lawyers and Family

Lawyers will have to work together to

ensure that such orders be made in the

most cost effective manner possible

for the benefit of the spouses and the

Trustees of the Pension Scheme.

On Saturday 29 June, twenty six teams

took part in the Younger Members

Annual Soccer Blitz at Blackhall Place.

Participants travelled the length and

breadth of the country and for the first

time our colleagues from the Law Library

entered a team.

Thefirst round matches kicked off at

about 10am and all eyes were on the

teams in football strips and printed T-

shirts. Female strikers were in demand

(only females could score goals) and like

the recent European Cup, many of the

matches were decided on penalties.

The tennis tournament got underway in

the afternoon. Many of the top footballers

were also tennis players and they spent

the afternoon alternating between the

pitch and the court.

At around 6pm Lavery Kirby & Co.,

Solicitors and Michael J. Staines & Co.,

Solicitors, alias 'the Sinners' contested

thefinal. The Sinners emerged the

victors. Steen O'Reilly & Co. were the

winners of the plate competition and

Thornton & Co., Solicitors, were the

runners up.

Mary Rose Gearty

BL (Law

Library) and

James Flynn

, Solicitor

(Daniel J. Reilly & Co) won this tennis

tournament.

We were delighted that the President,

Andrew F. Smyth

could attend the event

and present the prizes of the winners.

Many thanks to everyone who took part

in the event, to all spectators and

supporters and to all of the staff of the

Law Society for their help. A special

word of thanks to

Joan Doran.

Secretary

of the Younger Members Committee for

her hard work.
