THE HUMAN RIGHTS DIMENSION
OF THE ICC’S COMPLEMENTARITY REGIME

Abstract:
The article analyzes the mutual relationship between the principle of
complementarity and human rights (fair trial rights) and contributes to the debate
which addresses the question of whether a violation of human rights at the domestic
level renders a case admissible before the International Criminal Court. After a
preliminary evaluation of complementarity, this article describes the position of
international legal scholars and assesses the relevant case law of the International
Criminal Court. The article analyzes the
Al-Senussi
admissibility judgment issued by
the International Criminal Court’s Appeals Chamber in July 2014 which indicated
that certain ‘egregious violations of the rights’ of the suspect signify unwillingness
under Article 17 of the Rome Statute and therefore makes a case admissible before
the International Criminal Court. The article proposes a possible interpretation of
this concept in the light of the European Court of Human Rights’ jurisprudence,
namely in the light of the term ‘flagrant denial of justice’.
Resumé:
Předkládaný článek analyzuje vzájemný poměr mezi zásadou komplemen-
tarity a lidskými právy (právy souvisejícími se spravedlivým procesem) a přispívá
tak k debatě týkající se otázky, zda porušení lidských práv obviněného, ke kterému
došlo na vnitrostátní úrovni, činí případ přijatelným pro účely řízení před Meziná-
rodním trestním soudem? Po obecném vymezení článek popisuje pozici mezináro-
dněprávní nauky a dále hodnotí relevantní judikaturu Mezinárodního trestního
soudu. Článek analyzuje rozsudek o přijatelnosti vydaný Odvolacím senátem Me-
zinárodního trestního soudu v případu
Al-Senussi
v červenci 2014, který naznačuje,
že určitá zjevná porušení práv na vnitrostátní úrovni vyjadřují neochotu dle čl. 17
Římského statutu, jež činí případ přijatelným před Mezinárodním trestním sou-
dem. Článek naznačuje možný výklad pojmu „zjevná porušení práv“, a to s odka-
zem na rozhodovací praxi Evropského soudu pro lidská práva, konkrétně s ohledem
na institut „zjevného odepření spravedlnosti“.
