how and exempted under the
Regulation. However, the
Regulation does apply to pure
know-how agreements or mixed
agreements where the licensor
is not the developer of the know-
how or the patentee but is
authorised by the developer or
the patentee to grant a licence
or a sub-licence.
The Commission reserves the
right to withdraw the benefit of
the Regulation pursuant to
Regulation 1965/EEC where it
finds in a particular case that an
agreement exempted by the
Regulation nevertheless has
certain e f f ec ts wh i ch are
incompatible with the conditions
laid down in Article 85(3).
The Regulation expires on 31st
December 1999.
