Dear Sir,
I would ask vou to draw the attention of all
practising Solicitors to a matter, which is of
great importance to purchasers of-houses and
to the Municipality.
The Corporation will not take a road into
charge and light and maintain it unless such
road has been constructed in accordance with
the reqiiirements of the Corporation.
It is,
therefore, advisable that every Solicitor who
is acting for a prospective purchaser of a
house should, before completing the purchase,
enquire from the Corporation whether or not
the road on which the house is situated has
been constructed
to
the satisfaction of the
Corporation and is in charge, and if there are
any charges or notices of the Corporation
outstanding against
the premises.
Where
neglect
to make these enquiries occurs,
the
purchaser may find himself in possession
or in occupation, of a house on an unfinished
and unlighted road (a state of affairs for which
the Corporation is not responsible], with the
added disadvantage that the Corporation may,
at any time, feel bound to exercise its powers
under Section
28
of the Public Health (Ireland)
Act,
1878,
and reconstruct the road and provide
a lighting installation at the expense of the
then owners of the houses fronting on the road.
