examples of transterritorial administrative
decision making being based on the customs of international public law (e.g.
granting a promotion into the ranks of nobility); however, he admits that these
examples were already outdated when he was writing his work (1936). The issues
of horizontal transterritorial effect became a later subject of interest of several later
authors. In particular,

are to be
mentioned at this place. Despite a quite extensive list of scientific literature dealing
with this topic, the issue of horizontal transterritorial effects of administrative
decisions seems to still represent a rather poorly researched area nowadays. This
statement was very recently reaffirmed by the introduction to the monograph on
“Recognition of Foreign Administrative Acts”
, published in 2016.

9. It is a matter of fact that only a few international agreements have provided
for horizontal transterritorial effects of administrative acts. The Vienna Convention
of Road Traffic of 1968, which provides for transterritorial effects of driving
licenses, represents an example of such an agreement. In EU secondary legislation,
however, the level of formalisation of these transterritorial administrative acts has
become high enough
63
to allow for the identification of decision making paradigms
which are characterised by a significant level of coherence. For these reasons, these
“transterritorial” administrative decisions are coming under increasing scrutiny in the

public (administrative) law.
The topic is complex, as numerous examples of administrative decision making with
transterritorial effects can be found in the valid EU secondary legislation. Worthy
of mention here, for example, are authorisations for the sale of mineral waters
