auditor, who will then “calculate and certify” the proposed tax rate. The
final resolution for the board of elections must be filed no fewer than 90
days before the election where the issue will be considered.
Board must hold a public hearing if it wishes to change its levy within the
ten-mill limitation (i.e., the inside millage if the change will result in a tax
increase.) Two public notices of the hearing must be published with the
second notice not less than 10 nor more than 30 days before the
hearing.
The authority of school districts to levy property taxes for community
schools to include any school district that contains a community
school sponsored by an "exemplary" sponsor.
This authority applies to incremental levies, as well as incremental
levies.

TEACHER
RESIDENCY
PROGRAM, OHIO
Mentoring must be provided by any licensed teacher (and not just
one holding a lead professional educator license) during only the
first two years of the four-year program.
A required counseling component of the program must be provided if
the district determines that counseling is necessary.
However, one of the required measures of progression through the
program must be the performance-based assessment required by
the State Board for resident educators in the third year of the
program.
However, a career-technical education instructor teaching under an
alternative resident educator license may not be required to
complete the conditions of the first two years of the Ohio Teacher
Residency Program and may apply for a professional educator
license after successful completion of the requirements of the last
two years of that Program.

OBLIGATION TO
EMPLOY
The board of education shall employ teachers. However, “in all school
districts and in service centers no teacher shall be employed unless
such person is nominated by the superintendent of such district or
center.”
A board may re-employ a teacher whom the Superintendent refuses to
recommend, but it requires a three-fourths vote of the full membership.
The board shall enter into written contracts for the employment of all
teachers and is prohibited from decreasing salaries during the term of
the contract, unless it is part of a uniform plan affecting the entire district.

HIGH-PERFORMING
The State Board of Education is required to adopt rules to define a “high-
performing” teacher.
In addition, these rules must exempt consistently high-performing
teachers from the requirement to complete any additional
coursework for the renewal of an educator license and from any
requirements prescribed by the district's or school's professional
development committee in regard to such coursework.
