LAWYER EXCHANGE PROGRAMME

Because of the expansion of international business in

the years since World War II and the increased facilit

ies for international travel, lawyers, particularly those

in the younger age group, have manifested an interest

in visiting other countries for purposes of familiarizing

themselves with the language, customs and practice of

law in that country. The Council of the International

Bar

Association

accordingly

approved

a

Lawyer

Exchange Programme designed to achieve these ends.

From past experience it appeared that such a Programme

to be effective should be on a bilateral basis. Many

member organizations of the International Bar Associa

tion have named representatives to act as the liason for

this Programme and to be responsible for local arrange

ments. Lawyers who are interested in this Programme

should get in touch with Eric A. Plunkett who has been

named as

the pro-tem

liason

representative

for

the

Incorporated Law Society of Ireland.

STUDY VISITS BY LAWYERS TO COUNCIL OF

EUROPE

The Department of Justice has drawn attention to

Resolution

(69)

30, adopted by

the Committee and

Ministers of the Council of Europe on 26th September

1969. This Resolution refers to study visits abroad by

lawyers from member states of the Council of Europe.

The following are eligible

to make such study visits

subject to the prescribed conditions :—

1.

Law Professors and Lawyers engaged

in

law

teaching.

2.

Officials of

the State or of

local bodies or of

scientific institutions engaged in -legal work

3.

Judges.

4. Other practising lawyers.

Lawyers wishing to apply for a place for a study

must be prepared to study one or more aspects of the

folloiwnjr.

(a) The law of a member state of the Council of

Europe (this includes Ireland).

(b) The

law

relevant

to

the

institutions of

the

Council of Europe

the European Communities

and other European Organisations.

(c) The law relating to the conventions and agree

ments

of

the Council of Europe and other

European Organisations.

The Secretariat to the Department of Justice will

then make a list of the lawyers who they propose as

candidates for studies abroad and will endevour to abide

by the preferences expressed b" the candidates.

2.

The Secretariat of

the Council of Europe will

transmit its proposals with its comments to the states

concerned and will only make a final selection from

applications after it has received the agreement of the

states concerned. Normally the minimum period for a

study visit shall be at least one month. Candidates may

apply through the Department of Justice for financial

assistance to the Council of Europe if they require it.

Candidates must submit a long written report on the

work undertaken at the end of their study period :—

(a) To the Secretariat of the Council of Europe.

(b) To the Law Reform Division of the Department

of Justice.

(c) To the Ministry of Justice of any other state

concerned if applicable.

is

stated

to have

been lost or inadvertently destroyed. A new certificate

will be

issued unless notification

is

received

in

the

Registry within twenty eight days from the date of

publication of this notice that the original certificate

is in existence and in the custody of some person other

than the registered owner. Any such notification shouid

state the grounds on which the certificate is being held.
