THE POSITION OF THE INDIVIDUAL
IN POST-CODIFICATION DIPLOMATIC PROTECTION

Abstract:
To write about an issue in connection with diplomatic protection is both
an interesting and challenging task. In contrast to other publications on diplomatic
protection, that have the States involved in the dispute as their central focus,
this work considers the individual’s position in contemporary international law
from the angle of diplomatic protection. After acknowledging two key steps,
the human rights developments of the last decades and the codification of the law on
diplomatic protection in increasing recognition of the human rights of individuals,
the article examines the standing of the individual in diplomatic protection. Hence,
the challenge of whether and where to situate the individual in diplomatic protection
is the focus of this article.
Resumé:
Pokud si jako téma článku vybere autor problém týkající se diplomatic-
ké ochrany, vyvstane před ním zajímavý a náročný úkol. Na rozdíl od jiných textů
o diplomatické ochraně, které se zaměřují hlavně na státy, mezi nimž takto dochá-
zí ke sporu, předkládaný článek se zaměřuje na postavení jednotlivců v současném
mezinárodním právu z pohledu diplomatické ochrany. Na základě uznání toho, že
na základě rozvoje lidských práv v posledních desetiletích a kodifikace práva diplo-
matické ochrany dochází k rostoucímu uznání lidských práv jednotlivců, článek
zkoumá postavení jednotlivce v diplomatické ochraně. Hlavní výzvou článku je tudíž
otázka, zda a jak situovat jednotlivce v rámci diplomatické ochrany.

Introduction

legal system has undergone a remarkable evolution, especially regarding the substantive
and procedural rights afforded to individuals
