The

following were

among

the

matters

discussed :

Land Act, 1931, Section 31 (3) : Land Act,

1933, Section 48

The Secretary reported that he had

received

a letter from a member pointing out that in a

case in which lands had been vested in a tenant

by a Vesting Order in the Land Commission he

was unable to register a deed of transfer, owing to

the operation of Section 31

(3) of the Land Act,

1931 and Section 48 of the Land Act, 1933.

No

folio had been opened in the Land Registry owing

to the accumulation of Vesting Orders in the Land

Commission.

It was ordered that representations

should be made to the Secretary of the Irish Land

Commission for the repeal or amendment of the

sections, and that it should be enacted that in such

cases any transfer of the lands should continue to be

registered in the Registry of Deeds until the opening

of a folio for the holdings in the Land Registry.

Certified Copy Deeds

A member requested the opinion of the Council on

the following facts : A contract for the sale of part

of the lands comprised in a lease provided that the

purchaser should be entitled to a certified copy of a

lease. The vendor's solicitor furnished what pur–

ported to be a copy certified by another solicitor who

has acted some years ago in the matter.

In this

document the lands were described by reference to a

map thereon but no map appeared on the copy.

It was stated that there was no map endorsed on or

attached to the copy lease when the copy was

certified by the previous solicitor acting in the

matter. Query:

(i) is

the purchaser's solicitor

entitled to a certified copy of the map in question ?

(2) If so is the solicitor who furnished

the copy
