MEETING OF THE COUNCIL.
12th July,
Twenty-six members present.
Recovery of Rates.
A report was submitted from the Circuit
and District Courts Committee in reference
to proposed District Court proceedings by
Civil process for collection of rates.
It was
resolved that a letter be written to the
Minister for Justice requesting him to give
effect in the Courts of Justice Bill to the
recommendation contained in Clause 52 of
the Report of 1930 of the joint Committee
of the Oireachtas on the Courts of Justice
Act, 1924, " That Section 77 of the Act of
1924 be amended by inserting in A. at the
end of paragraph (IV) a further paragraph
empowering Count}' Councils, Urban District
Councils and Town Commissioners to sue
for rates," and that in addition to the
Bodies mentioned in this recommendation,
that
the
following be
included, County
Borough Councils, Borough Councils and
Drainage Boards.
The proceedings em–

rates
irrespective of amount.
OBITUARY.
MR. VINCENT P. MCGAHON, Solicitor, died
on the 19th July, 1934, at his residence,
Castleblayney.
Mr. McGahon served his apprenticeship
with Mr. Henry Murphy, Clones, was
admitted
in Trinity Sittings,
1926, and
practised at Castleblayney.
COMMISSIONERS FOR OATHS
(DIPLO
MATIC AND CONSULAR) ACT, 1931.
The Minister for Justice has requested
the Secretary to invite the attention of
members
to
the provisions of
this Act,
which is an Act to enable persons performing
Diplomatic or Consular
services outside
Saorstat Eireann to administer Oaths and
do notarial acts in the countries in which
they are performing such functions for use
in the Irish Free State and for other pur–
poses connected therewith.
Section 2 of the Act provides as follows :
(1) Every person to whom this section
applies maj^,
in any country or place
outside Saorstat Eireann in which he is
for the time being exercising the functions
of his office, administer any oath and take
any affidavit, and may also do any notarial
act which a notary public can do
in
Saorstat Eireann, and every oath, affidavit,
and notarial act administered, sworn, or
done by or before such person in such
country or place shall be as effectual as
if duly administered, sworn, or done by
or before any lawful authority in Saorstat
Eireann.
(2) Any document purporting to have
affixed thereon, or thereto, or to have
impressed thereon, the seal, and to have
subscribed thereto the signature, of any
person to whom this section applies in
testimony of any oath, affidavit, or act
being administered, taken or done by or
before him, shall be admitted in evidence
(saving all just exceptions) without proof
of the seal or signature being the seal or
signature of such person, or of the status
and official character of such person.
