Section 72 Declarations:
Secretarial Companies
The Conveyancing Committee was asked to give a view
on the acceptability of a Section 72 Declaration made by
an individual as secretary of a secretarial company which
in turn was the secretary of the land owning company.
The Committee's view was that a Section 72 Declaration
could properly be made by a director as the secretary of a
secretarial company in such circumstances.

2. The removal of minors from one jurisdiction
to another.
3. The legal status of company directors, their
civil and criminal responsibilities.
4. Free movement of goods within the EEC.

This Committee was set up in 1979 and consists of
representatives nominated by the Law Society and by the
Law Agents of the Building Society. The object of the
Committee is to resolve conveyancing difficulties which
may arise between practitioners in dealing with
mortgages, and to standardise the practice in dealing with
this aspect of conveyancing work.
The Committee will arbitrate on differences referred to
it by practitioners and will issue recommendations.
Practitioners or Bar Associations wishing to have
matters considered by the Joint Committee should
furnish details of the problem to the Joint Committee, c/o
The Law Society, with a detailed account of the problem
that has arisen.
The Committee meets once a month in Blackhall Place.
