GAZETTE

APRIL 1986

Correspondence

The Editor,

Law Society Gazette,

Blackhall Place,

Dublin 7.

7February, 1986

Dear Sir,

Having read the letter from Ann Fitzgerald in the

December Gazette, I immediately thought of the

immortal wording contained in Section 85 sub-section

(2) of the Housing Act 1966 in which the expression

"the appropriate Minister" is defined.

Can't you imaging Sir Humphrey in 'Yes, Prime

Minister' explaining it as follows:-

(a) if the Ministerial functions relating to the land in

question are vested in a single Minister other than

the Minister, that Minister,

(b) if those functions are vested in two or more Ministers

(neither or none of whom is the Minister), such one

of those Ministers as has, in relation to the land, the

greater or greatest concern,

(c) in all other cases, the Minister."

"Yes, Sir Humphrey!"

Yours faithfully,

Peter H. Jones,

Solicitor,

Goff Street,

Roscommon.

Dear Sir,

I am interested in a house exchange with an Irish

Solicitor and family in 1987.

We exchanged accommodation with an English solicitor

in the summer of 1985 and it worked very well. We

spent a few days in Ireland and fell hopelessly in love

with your country and your people. We hope to visit for

three weeks to a month.

Yours sincerely,

Richard M. Taylor,

Attorney at Law,

275 North Main Street,

P.O. Box 288,

Spanish Fork, Utah 84660-0288.

Dear Editor,

The following question was posed in an advertisement

for a Seminar being held by the Society on District

Court Civil Procedure and Debt Collection Enforcement.

"The Sheriff may still have the right to call out the

posse, but can he also seize property owned by the

debtor's spopouse(sic)?"

Very often the answer is in the question, is it.

"I suppose so"?

Yours sincerely,

Gerard M. Doyle,

Solicitor,

51 Lr. O'Connell Street,

Dublin 1.
