Professional Duty of Disclosure
Member acted for a claimant for damages for
personal injuries in a road accident case against the
owner and supposed driver of another car. When
the case had almost reached the settlement stage,
member ascertained that contrary to what was sworn
by the defendant and his son in the District Court,
the son who did not hold a driving licence was at
the wheel of the car when the accident occurred.
Member enquired whether he was under any duty
to disclose this matter to the defendant's insurers.
The Council on a report from a committee stated
