1. The contractor should be required to perform the work in a good, workmanlike manner in accordance with the  plans and specifications, and the contractor should give you at least an one‐year warranty against defects in labor  and materials.  There should be no penetration of the roof of the building nor the floor or foundation without the  approval of your regional construction manager.  In some circumstances, such as STOs, STRs and multiple tenant  buildings, third party approvals may be required prior to work affecting the roof, floor or foundation.   2. The contractor must perform the contractor’s work in accordance with any and all applicable codes, rules,  regulations, ordinances, and statutes of local, county, state and federal authorities.  You agree to indemnify  McDonald’s against any and all claims, costs or expenses arising out of the Installation Work.   3. The contractor should not commence work until he has furnished a certificate of insurance evidencing that he has  obtained the adequate insurance. Such certificates must provide that in addition to insuring you, that  McDonald’s, McDonald’s subsidiaries and affiliates, the owner of the property, and any landlord, if applicable, are  named as additional insureds as their interests may appear.  Certificates will state that insurers will provide  McDonald’s with at least 30 days prior written notice of cancellation or of material change in insurance coverage.  4. Upon completion of the work, the contractor should submit to you, the contractor’s, subcontractors’ and material  suppliers’ final lien waivers as well as a contractor’s sworn statement listing all subcontractors and material  suppliers. These documents are very important to you and McDonald’s since you are responsible for keeping the  Restaurant free of all liens.  If you have any questions about the type of documents to use or procedures to  follow, you should consult with your attorney.
