Retention and Payment of Criminal Defense

1.0 POLICY

T

he City of Greensboro recognizes there may be a need to assist in the criminal defense of City

employees who may be accused of criminal acts while performing in the course and scope of

their employment. Under the doctrine of Respondent Superior the City is considered liable for the

actions by the employee if they were considered as part of the employee’s occupation.

2.0 PURPOSE

T

his policy is to provide information and guidelines for employees and supervisors that pertain

to the circumstances upon which the City of Greensboro may provide for the retention and

payment of a legal defense for employees. However, this policy is not all inclusive and does not

guarantee any employee an absolute right to legal representation.

3.0 SCOPE

All benefit eligible employees and other (not benefit eligible) employees are covered by this policy.

4.0 DEFINITIONS

4.1

Benefit Eligible

- Full time and part time employees who are eligible for coverage and

participation in the City’s benefit programs in addition to legally mandated coverage.

4.2

Other (Not Benefit Eligible) Employee

- An employee assigned to a position designated

roster (RP), seasonal temporary (ST), or special project (SP) who is eligible for salary and

mandated benefits only.

4.3

Scope of Employment

- This includes all activities or duties of an employee that is owed

to the City and where the City, though supervisory chain of command, exercises direct or

indirect control of the employee’s activities. The scope of employment also includes all acts by

an employee that could be considered as reasonably necessary or incident to the performance

of their work including actions of personal convenience and comfort that do not conflict

with specific instructions. However, the scope of employment does not include any acts by an

employee that departed from their assigned duties and responsibilities in order to accomplish

the purpose of their work.

4.4

Types of Crimes

- By their nature crimes can be categorized between felonies and

misdemeanors.
