foreign criminal jurisdiction, was the debate only started but not completed during
the current session and will continue in 2017. Consequently, no draft article was sent
to the Drafting Committee.
The Commission adopted the draft articles or conclusions with commentaries
only with respect of three of the above mentioned topics under (a) Protection of
persons, on second reading, and (b) and (c) both on their first reading. In addition,
the ILC also adopted a few new articles or guidelines on Crimes against humanity
and Protection of the atmosphere. Regarding two other topics, namely Protection
of the environment and Immunity of State officials, the Commission only adopted
draft principles or articles with commentaries, discussed and refined last year. All the
new draft articles on those topics, as well as draft conclusions, principles or guidelines
in three other topics (f, g, h) were adopted just by the Drafting Committee, and the
Commission as a whole only took note of interim reports presented by the Chairman
of the Drafting Committee.
At its meeting on 2 May 2016 the Commission established a Working Group
on Identification of customary international law, chaired by Mr. Marcelo Vázquez-
Bermúdez, which discussed the project of commentaries prepared by the Special
Rapporteur.
At its meeting on 3 May 2016 the Planning Group decided to reconstitute
the Working Group on the Long-term Programme of Work. The Working Group
also discussed, on the basis of the submitted working papers, its methods of work
and two new proposals of possible subjects for the long-term programme. At this
session the Commission, on the recommendation of the Working Group, decided to
include the following topics on the long-term programme of work: (a) Settlement
of international disputes to which international organizations are parties, and (b)
Succession of States in respect of State responsibility.
In addition, the ILC had a number of meetings with representatives of other
legal bodies, such as the International Court of Justice (visit of its President Ronny
Abraham), the Asian-African Legal Consultative Organization (AALCO), the Inter-
American Juridical Committee, and the Committee of Legal Advisors on Public
International Law (CAHDI) of the Council of Europe. In the same vein, an informal
exchange of views was held between members of the Commission and the International
Committee of the Red Cross on topics of mutual interest, on the occasion of an
invitation to the premises of the ICRC Headquarters.
Last but not least, during the second part of the session of the ILC the International
Law Seminar took place at the Palais des Nations. At its fifty-first session a number of
members of the Commission gave lectures on a large variety of topics.
