INSANITY, PSYCHIATRY

AND CRIMINAL

RESPONSIBILITY

FINBARR McAULEY

This book is about the way in which mental disorder

affects, criminal responsibility. Unlike the standard

treatments of this subject, which tend to concentrate

on the jurisprudence o f the insanity defence, the

approach set out here also draws heavily on the

scientific literature on mental illness. The result is a

unique attempt to integrate the psychiatric

understanding of mental illness into a conventional

analysis of the knot of legal problems surrounding the

insanity plea.

There are chapters on all aspects of the insanity

defence, including the M'Nagh t en Rules, the notion

of volitional insanity as articulated by the Irish

Supreme Court; the form of the insanity verdict, the

proper limits of psychiatric evidence, the disposition

o f persons acquitted on the grounds o f insanity; the

problem o f psychopathy, the question of fitness for

trial and the need for a complementary defence o f

diminished responsibility.

Irish law and practice provide the core of the book,

although there is a wealth o f comparative material

drawn from a wide range of c ommon - l aw

jurisdictions.

Essential reading forjudges, lawyers, psychiatrists and

students of forensic psychiatry, criminology and

criminal law and all wh o have to grapple with the

problem posed by the mentally disordered defendant.
