(IRELAND) ACT, 1891.

Section 52 of this Act provides as follows :

" A right to be registered as the owner of

" any registered land in derogation of the

" title of the registered owner shall not be

" acquired by any mere possession, however

" long, commencing after the first registra-

" tion of the land, but where any person but

" for the provisions of this Act would have

" obtained a title by mere possession to any

" registered land, he may apply to the Court

" in the prescribed manner for an order

" declaring his title to such land, and the

" Court, if satisfied that such title would

" have been acquired but for the provisions

" of this Act, may make an order declaring

" such title, and ordering the register to be .

" rectified in such manner as it thinks just."

The question as to the chargeability to

stamp duty of a Circuit Court Judge's order

[

made under the above-recited Section was

recently before Mr. Justice Wylie on motion,

and he held that the order did not effect a

acquiesced in this decision, and Revenue
