POSITIONS

The board of education of any school district (apparently regardless of

size) may contract with the governing board of the ESC (from which it

otherwise receives services) to conduct searches and recruit candidates

for teacher positions.

RECRUITERS,

MILITARY

Boards must adopt a policy providing access to Armed Forces recruiters

in accordance with similar access given non-military recruiters. In

addition, recruiters are to be given the names and addresses of all

students in grades ten through twelve unless the parent submits a

written request not to release such information.

REDUCE STAFF

Boards may reduce the number of teachers by suspending contracts

because of decreased enrollment, return to duty of teachers from leave

of absence, suspension of schools, territorial changes, or financial

reasons. No collective bargaining agreement approved after September

29, 2005 can remove “financial reasons” as one of the criteria for a staff

reduction. No collective bargaining agreement approved after

September 29, 2011 can give preference to seniority in staff reductions

or recall from a suspended contract (except when making a decision

among teachers with comparable evaluations).

ORC 3319.18 addresses the implementation of a reduction in force

made necessary by a transfer or consolidation of school territory.

In non-Civil Service districts, a board may reduce nonteaching staff

because of decreased enrollment, return to duty of staff on leave,

suspension of schools, territorial changes, or financial reasons. No

REDUCTION IN

FORCE,

ADMINISTRATOR

If the Board has adopted a policy on the suspension of administrative

contracts, it may suspend contracts in accordance with that policy. Ohio

law specifically recognizes “financial conditions” of the district as one of

the authorized reasons for the contract suspensions. The policy (which

must address such issues as reasons for suspension, order of

suspension, and restoration rights) must be developed from input from

the superintendent and all administrators.

ORC 3319.18 addresses the implementation of a reduction in force

made necessary by a transfer or consolidation of school territory. If

years of service as a teacher are to be included in the determination of

the contracts to suspend (assuming that no collective bargaining

agreement limits this), the years of service both in the previous district

(and in any district which had previously been transferred or

consolidated into that previous district merging with another) shall be

considered if it is part of the administrator suspension policy.

REHABILITATION,

BUS DRIVERS AND

OTHER NON-

LICENSED

PERSONNEL

If a bus driver’s background check indicates a potentially disqualifying

event, the driver may be eligible for employment if he or she meets the

rehabilitation standards prescribed for non-licensed staff members under

rule 3301-20-03 of the Ohio Administrative Code.

REHIRED RETIREE

The law specifies that a rehired retiree will receive a single life annuity as

the retirement benefit from this “second employment.” The law specifies

options that the retiree may have, as well as timelines for the payment of

the benefit. The penalty for returning to work within 60 days of

retirement is the forfeiture of the retirement benefit which would have
