6) A statement that if the student fails to achieve the required

score on the required assessment by the end of third grade, the

student may be retained in third grade.

Annually, each school district shall report on its implementation of and

compliance with the third grade reading guarantee. Based on the

information to be reported by the superintendent of public instruction, it

would appear that districts will be required to report:

1) the number and percentage of students in grades K-4 reading

below grade level based on the diagnostic and the achievement

assessments and aggregated by district and by building;

2) types of intervention services provided; and

3) an evaluation of the provided services (if available).

If the district offers “intensive interventions in reading” through a summer

reading camp, it must comply with the nutrition requirements in ORC

3313.813.

Summer remediation services funded in whole or in part by the state

must also meet the following criteria:

1)Methods must be based on reliable educational research;

2)Assessments must be conducted before and after student

participation in order to monitor results; and

3)Parents of participating students must be involved in programming

decisions;

Boards of education are required to adopt a policy prohibiting the use of

or possession of tobacco products by students while on school property

or at school-sponsored events.

Once they are developed, all high schools will be required to use a form

and methods for documenting on high school transcripts those credits

earned that are compatible with the standards for credit transfer and

articulation.

TRANSFER OF

DISTRICT

TERRITORY

INVOLVING AN ESC

The transfer of all or part of the territory of a local school district to

adjoining local districts or one adjoining local district can be initiated by

the governing board of the local district’s educational service center so

long as all involved districts are located within the territory of that ESC.

The transfer of the territory can then be approved at the next regular

meeting of the ESC governing board held at least 30 days after approval

of the initial resolution on the transfer. However, if a petition of

referendum signed by a majority of the electors voting in the last general

election and residing in the affected area is filed with the ESC

superintendent, the issue will be presented to voters at a subsequent

primary or general election (held at least 75 days after the filing of the

petition) or at a special election specified in the petition.

A transfer can also be initiated by a petition signed by 55% of the

qualified electors voting in the last general election and residing in the

territory proposed for transfer. The vote on this petition of transfer

follows the same procedures as the petition of referendum.
