the administration of insulin and other medications, are to be

provided in schools,

School districts are required to notify a suspected diabetic student's

parent, guardian, or other person having care or charge of the

student that the student may be entitled to a 504 plan under federal

law.

In addition to permitting (but not requiring) a school district to

provide diabetes care training to school employees, districts are

also permitted to train certain school employees and bus drivers in

the recognition and treatment of diabetes-related emergencies.

Districts must permit a student with diabetes to attend the school

that the student would otherwise attend if the student did not have

diabetes.

Districts must also allow a student with diabetes to manage the

student's own care if the student's treating physician determines that

the student is capable of doing so.

However, a school employee is not subject to disciplinary action

under school or district policies for not providing care or performing

duties under the bill.

School employees and boards of education are granted qualified

immunity from civil liability for activities authorized by the bill.

Districts are also require to report annually to the Ohio Department

of Education the number of enrolled students with diabetes in the

district and the number of errors associated with the administration

of diabetes medication.

A school district may contract with an educational service center for

the purpose of procuring the services of school nurses, registered

nurses, and licensed practical nurses to provide the diabetes care

for students in the district.

DIAGNOSTIC

ASSESSMENTS

The state board of education is required to adopt a diagnostic

assessment aligned with state standards and model curricula for

reading, writing, and mathematics for grades K-2 and in reading and

writing for grade 3.

School districts are required to administer diagnostic assessments to:

any student transferring into the school from another school if

the appropriate diagnostic assessment has not yet been

administered at the receiving school;

each kindergarten student with the kindergarten readiness

assessment to be administered between the first day of school

and November 1; and

each student enrolled in grades kindergarten, one, two, or

three. The diagnostic assessment for students in grades 1-3 is

to be completed by September 30.

Data from the diagnostic test administered to kindergarten students will

be used for purposes of the school and district report cards. The results

of this kindergarten diagnostic test will be reported to ODE and are not

subject to a parental opt-out.

Students with “significant cognitive disabilities” (as defined by ODE) are

exempted from the diagnostic assessments.
