Trade Unions

Where the executive cou.xil of an amalgamated trade

union has been paralysed by reason of disputes between

its component parts, so that it is unable to perform its

functions in litigation involving its members, and the

litigation touches or concerns union property, the union's

trustees are empowered under Section 9 of the Trades

Unions Act, 1871,

to authorize solicitors

to

take all

necessary

steps

for

the union's protection

in

such

litigation.

[Keys and another v Boulter and others; Court of

Appeal.]

Words and Phrases

A company whose business is the preparation of meals

in factories and their delivery to airlines for consumption

on aircraft was held not to be liable for the levy under

the Industrial Training Act, 1964, because the activities

not within scope as "the supply in the course of any

business of food or drink

to persons

for immediate

consumption" in paragraph 1

(a) of the schedule to the

Industrial Training (Hotel and Catering Board) Order,

1966.

[N.A.S. Services Ltd. v Hotel and Catering Industry

Training Board; Court of Appeal; 15 October 1970.]

The meaning of "national origins" as a prohibited

ground of discrimination in Section 1

(1) of the Race

Relations Act, 1968, was argued in the action by Baling

London Borough Council for a declaration that the

council's rule limiting applications for housing accom

modation to British subjects was not unlawful.
