of 1995. The New Transatlantic Agenda was a comprehensive statement of the many

areas for common action and cooperation.

On the 25

th

June of 2003 the Agreement on Mutual Legal Assistance between

the European Union and the United States of America

was signed. This Agreement

regulates following areas of cooperation: identification of bank information, joint

investigative teams, expedited transmission of requests, mutual legal assistance

to administrative authorities, protecting of personal and other data, request for

confidentiality.

However political and operational cooperation between the EU and the US gained

momentum after September 11, 2001. The «Washington Statement» 2009 sets out

a joint EU-US commitment to cooperation in the area of Justice and Home Affairs

area. This statement is adopted at a time when the EU is setting out new ambitions

for its policy for the area of Justice, Freedom and Security with the adoption of a new

multiannual policy programme of 2009, the Stockholm Programme.

In light of the

Lisbon Treaty’s entry into force on 1 December 2009, which brought about significant

changes to the provisions relevant to the area of Freedom, Security, and Justice

(Title V of the Treaty on the Functioning of the European Union), the Stockholm

Programme establishes the framework for police and customs cooperation, rescue

teams, cooperation on criminal and civil affairs, and policy on asylum, immigration

and visas, for the 2010 –2014 period. This process will lead to an update of the EU

policies, many of which have a transatlantic dimension. The U.S. has reaffirmed

a foreign policy based upon its values and ideals, while also protecting the American

people and building new justice and home affairs programs and partnerships in

furtherance of this policy.

1. History of contemporary EU-U.S. cooperation on home affairs

The EU and the U.S. seek to expand and intensify cooperation notably in the

areas of: trafficking in human beings; smuggling of migrants; sexual exploitation

of children, including depictions of such abuse of children on the Internet; drug

trafficking; trafficking of other illicit goods; financial crimes; cyber crimes; corruption;

tracing and confiscating the proceeds of criminal activity.

For example, the Agreement on customs cooperation and mutual assistance

in customs matters 1997 was designed the European Community and the United

States. On 22 April 2004, was signed a new Agreement

which extended the scope of

the 1997 Agreement. In order to cover supply-chain security of transatlantic trade,
