řešit jeho negativní vliv. Autoři mají dále za cíl, s odkazem na mezinárodní instituty

a praxi, představit návrhy na řešení problému paralelismu a nastínit možné alterna-

tivní řešení současného systému. Autoři si ve finále kladou otázku, zda se mohou

dvě paralelní řízení najednou střetnout, a pokud ano, které z nich má z tohoto střetu

vyjít jako vítězné.

On the Authors:

Mgr. Zuzana Jahodníková, LL.M., is a junior lawyer at ROWAN

LEGAL (Bratislava). After graduating from the University of P. J. Šafárik in Košice

(Slovakia), she attended Leiden University (the Netherlands), where she was awarded

an LLM Cum laude title in European law. She focuses her practice on litigation and

counselling relating to disputes with foreign aspects. Her main areas of interests are

in European Union law, European protection of human rights and international

dispute settlement methods.

JUDr. Ing. Miloš Olík. LL.M., is the head of ROWAN LEGAL’s dispute resolution

practice, where he specializes in investment disputes, international commercial

arbitration, sport arbitration and various forms of alternative dispute resolution. He

has considerable experience in arbitration proceedings under the rules of ICC, ICSID,

SCC, the Arbitration Court Attached to the Economic Chamber of the Czech Republic

and the Agricultural Chamber of the Czech Republic, the Arbitration Court of the

Slovak Chamber of Commerce and Industry, and, additionally, under ad hoc rules,

including the UNCITRAL Rules. Miloš Olík has also sat as arbitrator in national and

international commercial disputes, domain name disputes and consumer disputes. He

has been included on the LCIA’s database of neutrals, the VIAC’s List of Practitioners

in International Arbitration and HKIAC’s List of Arbitrators. He is also on the list of

arbitrators of the Football Association of the Czech Republic. He is the author and

co-author of a number of professional articles and publications.

1. Introductory remarks

At first glance, the concept of arbitration has as its pivot the idea of introducing a

case to a neutral forum created by parties to the dispute who have agreed to this step.

Besides this main inducement, arbitration offers investors lucrative features, such as:

participation in the adjudicator selection process; active engagement in the dispute

resolution process; the possibility to take part in a dispute resolution process which

is devoid of excessive formalism and allows access to confidential proceedings which

are normally held behind closed doors; and the opportunity to be given an effective

apparatus when it comes to any eventual award enforcement.
