GAZETTE

DECEMBER 1991

(Vi ewpo i nt Con t ' d)

quate safeguards to protect clients

against any possibility of exploita-

tion. Against that background, one

would, naturally, have expected the

Solicitors (Amendment) Bill to have

contained a provision removing all

statutory controls on solicitors

remuneration. Alas, such is not the

case. The legal controls remain.

We wou ld simply say to the

Government that they cannot have

it both ways. It is, in our view,

completely inconsistent w i th any

reasonable notion of competition to

maintain a framework of legal con-

trol on the charges that solicitors

make for certain legal services in a

context in which there is to be free

and open competition in the pro-

vision of legal services; all the more

so in a situation where there is an

infrastructure, including a Legal

Ombudsman, to deal w i th com-

plaints about overcharging. We

would ask the Government to think

again.
