1.3
A resolution under Regulation 1.1 may be passed only after the person shall
have been informed of the complaint and afforded an opportunity of making
representations on the matter to the GGCA Executive Committee; and in
accordance with such other procedure as the GGCA Executive Committee
may determine
1.4
Notice of the passing of such a resolution shall be given forthwith to the
person to whom it relates and the notice shall inform the person of the right to
refer the matter to the Appeal Committee in accordance with Regulation 5.1.
1.5
A resolution by the GGCA Executive Committee in accordance with this
Regulation shall take effect on the date on which it was passed save that
where in a case of expulsion the person concerned gives notice of appeal the
person shall be suspended from membership pending the disposal of the
appeal. Save as provided in Regulation 6.1 the decision of the GGCA
Executive Committee shall be final.
APPEALS COMMITTEE
2.1
There shall be an Appeal Committee consisting of 5 members of the Union
nominated and appointed by the GGCA Executive Committee. No member of
the GGCA Executive Committee shall also be a member of the Appeal
Committee.
2.2
Each meeting of the Appeal Committee shall appoint its own Chair and the
appeal shall be decided by a majority vote of the members of the Committee
present throughout the hearing but the Chair shall have a casting vote in case
of equality.
RIGHT OF APPEAL
3.1
There shall
be a right of appeal to the Appeal Committee in the following
cases:
(1)
where the GGCA Executive Committee has decided that a member
shall be expelled from membership, or is ineligible for membership
under Rule 2.1, and that person is dissatisfied with the decision; an
appeal under this Regulation shall however be limited to the question of
whether the GGCA Executive Committee’s decision is or is not correct
in relation to the appellant and nothing in these Rules and Regulations
shall be construed as conferring upon the Appeal Committee any
power to vary or override any determination previously made by the
GGCA Executive Committee;
