cover-note.

company enquired whether there is any profession
objection to the printing of their name by the
company on its cover-notes. Members were informed
that in the view of the Council the use of such
cover-notes would be contrary to professional
etiquette.
Negligence by Local Government Solicitors.

Secretary reported that representations had
been made to the Department of Local Government
on the subject of section 50 of the Local
G ovetnm e
Bill, 1954, which provides that where a person
retained' by a public body in any professional^
advisory, or consultative capacity certifies any s;um
as being payable from the funds of the public body
and such sum is paid such person shall be deemed
to be an officer of the public body for the purpose
o f section 20 of the Local Government (Iieland)
Xct 1 02" as amended. The effect of this provision
is to mak; such person liable to Local Government
audit and accountable for negligence on the ceItibcate
of the auditor without a judgment o f a Lour .
Representations had been made that soliators
retained on a taxed costs basis should be express y ,
excluded from the scope o f this section.
The
Minister, while unwilling to alter the section
drafted, had expressed the view that it is not sten ted
to apply to such solicitors and had agreed that a
letter should be written to the Society clarifying
the intentions of the Department in this respect.

regard to the provisions of the Solicitors’ Act, 195 4,
