IRISH BUILDING CONTRACTS

The RIAI Condi t ions and the Government Condi t ions of

Contract

to be held in DUBLIN on the 12th & 13th November, 1985

The majority of building work in the Republic is carried out under the RIAI Conditions 1977 or the Government Conditions of

Contract. All too often the parties take these documents as read, with most unfortunate consequences. This course aims to

provide a detailed understanding of the Contract Conditions and the general law on which they are based. Particular emphasis

will be placed on problem areas — especially those relating to claims for time and money, problems with liquidated damages,

possession of site, and sub-contractors, whether nominated or otherwise — and the accent will be practical rather than

theoretical.

The Legal Background. Letters of Intent. Express and implied terms. Signature or seal. Limitation

periods.

Session 2

Delays and extensions of time

The practice and procedure. Problem areas. Consideration of grounds: the roll-on effect. Calcula-

tion of liquidated damages. Are liquidated damages always enforceable?

Session 3

Certificates and payments

2.15 p.m.-3.30 p.m.

The contractor's entitlements. Effect of certificates. Challenging certificates. Variations. Fluctua-

tions.

Session 4

Open Forum and Discussion

3.45 p.m.-5.00 p.m.

Contractor's money claims

9.30 a.m.-10.45 a.m.

What is recoverable? The usual heads of claim. How the claim is assessed. Prolongation or

disruption? Loss of productivity and other problem areas. The contract procedures.

Session 2

Problems with third parties

Sub-contractors and suppliers. Employer's licensees. Main contractor's liabilities. Claims by and

against sub-contractors.

Session 3.

Nominated sub-contractors

The problems involved. The contract procedures. Design liabilities. Collateral agreements. Effect

of delay or failure by nominated sub-contractors.

SPEAKERS

DR. VINCENT POWELL-SMITH, LLM, DLitt, FCIArb, is a Consultant specialising in building contract claims and practice. A

former University Lecturer, he is a practising arbitrator and Legal Correspondent of "Contract Journal". His many books on

construction law and practice include "Building Contract Claims", "Contract Documentation for Contracts" and

"Determination and Suspension of Construction Contracts" (all with John Sims), "The JCT Standard Form of Building Contract

1980" and "A Building Contract Dictionary". He is joint Editor of "Construction Law Reports".

JOHN SIMS, Esq., FRICS, FCIArb, a Chartered Quantity Surveyor, specialist in building contracts and arbitration. He is

correspondent of "Building" and a well known lecturer. He is co-author of "Building Contract Claims", "Contract Documen-

tation for Contractors" and "Determination and Suspension of Construction Contracts".
