Irish Solicitor

Appears Before

Privy Council

It must be unique that an Irish practising solicitor

represents a party to an appeal before the Judicial

Committee of the Privy Council. Max Abrahamson, the

Dublin Solicitor (assisted by Michael O'Reilly,

Solicitor) has just had that experience. Max acted for

the Appellant in a case called

Mitsui

Construction

Company Limited

-v-

The Attorney General of Hong

Kong

which was an appeal from a decision of the

Supreme Court of Hong Kong. The case concerned the

interpretation of a contract for the construction of a

pipeline between Hong Kong and mainland China. The

judgment of Privy Council was delivered on the 10th of

February, 1986, and was found in favour of the

Appellant. This particular case started as an arbitration

heard in London and then proceeded on points of law

through the Hong Kong High Court and the Hong Kong

Supreme Court of the Privy Council. Max Abrahamson

is the author of "

Engineering Law and the I.C.E.

Contracts".

An interesting tailpiece. The Q.C. instructed by Max

for the Privy Council appeal was Sydney Kentridge,

now the central character in a London play (and T.V.

documentary) as a result of his representing the next of

kin at the South African inquest on the death of Steve

Biko.
