LEGAL ACTION

In the event Parks sues for commission, all expenses, including court costs and attorney’s

fees, are deducted from the commission before the commission is paid to the agent.

Management makes all decisions regarding legal action.

Should the agent and Parks be named in any legal action, attorney’s fees and other costs

will be borne by the named parties. The Parks agent shall be responsible for their E & O

deductible and any associated costs with the legal action, including but not limited to any

settlements, judgments, etc.

LEGAL AND CODES OF ETHICS COMPLIANCE

Parks intention and policy is to obey all applicable federal, state, and local laws and comply

with TREC rules and regulations and Realtors

®

code of ethics. Agents sign a fair housing

declaration. Prior to placing any phone solicitation, agents should contact our Marketing

Department for access to Do Not Call information.

AGENT TRANSFERS

If an agent is transferring to another office within the company or to another company, the

agent should obtain the Principal Broker’s signature of the destination office then present

to Principal Broker for signature, utilizing the TREC 1 form.

TRANSFER OF LISTING(S)

If an agent is transferring to another company and wishes to transfer listing(s), the agent

must obtain the seller’s signature on the appropriate MLS form and the destination

Principal Broker’s signature on agreement to pay 25% of the commission to Parks. This

runs with the listing and that agent until closing of sale.

TERMINATION AND AFFILIATION

The Principal Broker makes all decisions regarding affiliating and releasing agents.
