5.4 Vehicles - Smoking in a City vehicle is prohibited even when the only occupant is a smoker.

5.5 Enforcement - Each department director is responsible for enforcing the smoking regulations

for their employees. Repeated violations will be handled under existing disciplinary procedures as

insubordination. Managers who fail to carry out their responsibilities in this policy are also subject

to corrective action.

See the Corrective Action policy on page 272 in Section H.

5.6. Nothing in this policy alters existing rules regarding morning and afternoon break periods.

6.0 PROCEDURES

6.1 Employees

A. Supervisors will inform all employees of this policy and smokers will be shown any

designated outdoor smoking areas for the facility in which they work.

B. If an employee fails to abide by the rules of this policy, he will be subject to corrective action.

See the Corrective Action policy on page 272 in Section H.

C. If an employee has a complaint about a violation of this policy, he should discuss it with

his supervisor or other appropriate departmental official. Employees may also discuss their

concerns regarding this policy with the Employee Relations staff in Human Resources or the

Safety and Health Manager.

6.2 Citizens - Since this policy applies to citizens visiting City facilities as well as employees,

enforcement should be handled as follows:

A. Inform the citizen of the City policy regarding smoking only in outdoor areas.

B. Ask the offending citizen to go to an outdoor area.

C. If the citizen fails to go outside, normal trespassing enforcement may be instituted and/or

the citizen should be refused any City service until they voluntarily comply.

D. Employees violating the smoking policy will be required to review the appendix document,

Work Place Smoking Acknowledgment .

In addition, corrective action up to and including

termination may be implemented.
