CERTIFICATE OF

REVENUES (THE 412

CERTIFICATE)

The superintendent is one of three individuals who must sign a “412

certificate” to attach to all qualifying contracts. However, if the district is

in fiscal emergency, then the certificate is signed by a member of the

district’s financial planning and supervision commission. The other

signatories to the certificate are the treasurer and the president of the

board of education.

A “qualifying contract” for which a 412 certificate is required is any

agreement for the expenditure of money under which the aggregate

payments from the funds included in the school district’s five year

forecast will exceed the lesser of:

$500,000; or

One percent of the total revenue to be credited in the current fiscal

year to the district’s general fund, as specified in the most

recent certificate of estimated resources.

There is also an alternative 412 certificate. This requires that the district

is signing a contract for a multi-year agreement for materials, equipment,

or non-payroll services essential to the district and that the savings over

the duration of the contract are greater than for a single year contract.

The multi-year contract must also allow the district to reduce the deficit it

is projecting in its five year forecast. The signature requirements for this

certificate are identical to those for the standard 412 certificate.

CHARTERING OF

SCHOOL DISTRICTS

The State Board of Education shall establish standards, classify and

charter school districts and individual schools, and revoke charters of

schools that fail to meet standards.

The state board of education is empowered to revoke the charter of any

school district or school which fails to meet the minimum standards

prescribed by the board. If a school district charter is revoked, the state

board may dissolve the district and transfer its territory to one or more

adjacent districts. Prior to this transfer, the state board is required to

notify the appropriate ESC governing board and all adjacent district

boards of education of the pending dissolution and accept

recommendations regarding the transfer of territory. While the state

board is required to devise “an equitable division of the funds, property,

and indebtedness,” the board of education of a receiving school district

“shall accept” the territory in accordance with the order of the state

board. However, the state board’s order is subject to a referendum of

the voters in the affected territory if a petition signed by a majority of the

number of electors voting in the last general election is submitted.

School districts are classified as city, local, exempted village,

cooperative education districts, or joint vocational school districts.

CHICKEN POX

EPIDEMIC

If the director of the state health department declares that a chicken pox

epidemic occurs in a school’s population, the school may deny

admission to a pupil otherwise exempted from the chicken pox

requirement until such time as the health director declares that the

epidemic no longer exists. The policy adopted by the board of

education must prescribe procedures to preserve the student’s

academic standing during the time that the child is excluded from

school.
